General terms and conditions of sale

Preamble and general definitions

These General Terms and Conditions of Sale (GTCS) govern the use of services offered by Phenomen’âme, a single-member limited liability company (EURL) with a share capital of €1,000, whose registered office is located at 58 rue de Monceau, 75008 Paris, registered in the Paris Trade and Companies Register under the number SIREN 929 422 855 and SIRET 929 422 855 00015.

The company is legally represented by Sophie Petithomme in her capacity as director and service provider.

These GTCS govern the contractual relationship between Phenomen’âme and any person using its event image consulting services, whether in a personal or professional context.

To ensure a clear understanding, the following terms are defined as follows:

  • Image consulting: Personalized recommendations and strategies relating to clothing style, accessories, beauty enhancement, posture, presence and non-verbal communication, provided in the context of personal or professional events (wedding, religious ceremonies, award ceremony, appearance & speech, etc.), based on an analysis of the client’s colorimetry, body shape, personality and objectives, with the aim of creating a coherent, aligned and radiant image, in harmony with the occasion.

  • User: Any person accessing the Phenomen’âme website, for the purpose of consulting or browsing it.

  • Client: Any person who engages the consultant’s services.

  • Service: All image consulting services for special events provided by Sophie Petithomme, including in particular the selection of outfits, accessories, beauty enhancement, posture, and non-verbal communication.

  • Service provider / Consultant: Refers to Sophie Petithomme in her capacity as a professional image consultant.

  • Consumer client: Any individual who acts for purposes that are not related to their commercial, industrial, craft, professional, or agricultural activities.

  • Non-professional client: Any legal entity that does not act for professional purposes.

  • Professional client : Any individual or legal entity, public or private, acting for purposes within the scope of their commercial, industrial, craft, professional, or agricultural activities, including when acting on behalf of or for the account of another professional.

  • Goods with digital elements: Any tangible movable good that integrates digital content or a digital service, or is interconnected with such content or service, in such a way that the absence of this digital content or service would prevent the good from fulfilling its functions.

  • Digital content: Data produced and provided in digital form.

  • Digital service : A service that enables the consumer to create, process, store, or access data in digital form, or a service that allows the sharing of or any other interaction with data in digital form that is uploaded or created by the consumer or other users of this service.

  • Durable medium: Any instrument which enables the consumer or the professional to store information personally addressed to them, so they can refer to it later for a period of time appropriate to the purposes for which the information is intended, and that enables the identical reproduction of the stored information.

  • Functionality: The ability of a good, digital content, or digital service to perform its functions in relation to its intended purpose.

  • Compatibility: The ability of a good, digital content, or digital service to operate with hardware or software with which goods, digital content, or digital services of the same type are normally used, without requiring the conversion of said goods, hardware, software, digital content, or digital services.

  • Durability: The ability of a good to maintain its required functions and performance under normal use.

  • Personal data: Personal data as defined in Article 4, point 1, of Regulation (EU) 2016/679 of April 27, 2016, concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data.

 

Article 1. Preliminary information

In accordance with the legal pre-contractual information requirement applicable to all professionals, these General Terms and Conditions of Sale (GTC) include the mandatory provisions set out in Articles R111-1 and following of the French Consumer Code.

The General Terms and Conditions of Sale detailed below outline the rights and obligations of the image consultant Phenomen’âme and her clients.

Any user of the website www.phenomename.com is required to regularly review the general terms and conditions of sale and to read them before making any payment. This document constitutes a contract of adhesion binding the client to the consultant upon acceptance.

The applicable law for these general terms and conditions of sale is exclusively French law, to the exclusion of any foreign elements that may cause a conflict of laws or international jurisdiction. Only French courts shall have jurisdiction in the event of a dispute.

In order to access the free and paid services of the consultant, you must have full legal capacity:

  • Be an adult (over 18 years old) at the time of signing the contract and not be subject to any total or partial incapacity;

  • Be a minor but have authorization from a legal representative at the time of signing the contract and not be subject to any total or partial incapacity;

  • Be legally authorized to represent a legal entity (having a mandate) at the time of signing the contract.

The client hereby certifies that they have the appropriate electronic equipment to use the consultant’s services, namely: A computer, a mouse, a camera, a microphone, headphones, a high-speed internet connection, a reliable application such as Google Chrome, an active credit card, and a Notion account.

All costs incurred by the client for the use of the consultant’s services shall remain their responsibility (for example: purchase of computer equipment, internet connection, etc.).

The client acknowledges:

  • that they are solely responsible for the use they make of the website www.phenomename.com;

  • that the communication of their identification details is done at their own responsibility;

  • that they are aware of the nature of the internet (technical performance, response times for querying or browsing);

  • that it is their responsibility to ensure that the technical characteristics of their computer allow them to access the website www.phenomename.com correctly;

  • that it is their responsibility to take appropriate measures to protect and back up their own data and software from potential virus contamination.

Consequently, the consultant shall not be held liable for any direct or indirect damages arising from the use of the website and/or the internet and/or viruses.

To modify or update the client’s account or sensitive data, the consultant may require identity verification, in the most appropriate form.

If a failure to meet the capacity requirements or prerequisites is observed, the client or user will have their access suspended until the issue is resolved. It is therefore essential that the client or user carefully fills out the fields regarding their personal data.

These terms and conditions of sale and use are only available in French and English, for consultation and interpretation. The services offered can only be accessed in French and English by clients and users. In the case of international purchases or sales, which involve a foreign element in the person of the contracting party, the provisions of French law will remain applicable.

The client may request from the consultant a dated copy, either printed or digital, of the terms and conditions of sale applicable at the time of the order or booking.



Article 2. Independence of clauses and parties

All clauses of these General Terms and Conditions of Sale are independent from one another. Consequently, the potential invalidity of one clause shall not affect the validity of the others, which shall continue to produce their full legal effects. The nullity of one clause shall not compromise the validity of the contract entered into between the parties.

The parties agree to maintain their full independence and acknowledge that this partnership does not constitute an employment contract, a shareholders’ agreement, or a partnership agreement. This professional collaboration shall in no way be interpreted as a merger, demerger, or the creation of a new legal entity. Neither party shall, by virtue of this agreement alone, acquire any shares, equity, or voting rights in the other party’s company, unless otherwise expressly agreed between them.

 

Article 3. Event image consulting services

Phenomen’âme offers tailor-made image consulting services for special occasions. These services include recommendations on clothing style, accessories, beauty enhancement, posture, body language, and non-verbal communication.

They are intended for both individuals and professionals, in the context of meaningful personal or professional events.

Each service begins with a free 20 to 30-minute discovery call to identify the client’s needs, style and communication objectives, and to propose a tailored service adapted to the upcoming event.

The various services are detailed on the website www.phenomename.com, and are categorized by type of event:

  • Wedding

  • Religious Ceremony

  • Birthday

  • Reception

  • Award Ceremony

  • Appearance & Public Speaking


Requests outside of these categories may also be considered, provided they relate to image consulting for a specific occasion.

Complementary Services

Phenomen’âme may occasionally offer additional services such as:

  • Event colour analysis: identifying the shades that enhance the client’s natural complexion and presence.

  • Event wardrobe edit: assessing and optimizing existing pieces, refining the client’s style, and aligning their wardrobe with their image goals.


Nature of the services

All services listed are indicative and may evolve based on the specific needs expressed by the client. They are formalized in a personalized quote, which is the only binding contractual document.

For every category, the support may include one or more of the following dimensions: image assessment, outfit selection or creation, accessory coordination, beauty enhancement, posture guidance, body language, non-verbal communication, and photogenic presence.

WEDDING

Specific Provisions

The client acknowledges that the advice provided by the consultant is in no way mandatory. These are professional and personalized recommendations, based on an analysis of the client’s color harmony, body shape, personal style, personality, event context, and identified communication goals.

The techniques used are designed to enhance the client’s image and self-perception, in accordance with the consultant’s specific approach.

If necessary, the consultant reserves the right to adapt the content of her services according to the client’s expressed needs. Tailor-made programmes are provided for guidance purposes only. Offers and services are subject to change without notice for future sessions.

Custom arrangements may be agreed upon by both parties, subject to validation through a personalized quote and a signed contract within the agreed timeframe.

In the event of a dual agreement (general terms and specific terms), the specific terms shall prevail.

 

Article 4. Duration and frequency of services

  • Image coaching related to a wedding, religious ceremony, birthday, reception, award ceremony, public appearance or speech — or any other type of event — is subject to a personalized schedule agreed in advance with the client, ensuring a tailor-made experience aligned with their specific needs.

  • Colour analysis session: approximately 1 to 1.5 hours
    Event wardrobe edit: duration to be adjusted depending on the wardrobe’s size and content

The durations mentioned are estimates, which may evolve according to the actual needs expressed during the session.

Both the consultant and the client agree to respect the scheduled dates and times. Any request for modification must be submitted as early as possible in order to preserve the quality of the service process

 

Article 5. Consultant’s availability

Phenomen’âme’s working schedule is as follows: Monday to Friday, 10:00 AM–1:00 PM / 2:00 PM–6:00 PM, excluding public holidays and vacation periods communicated to the client in the contract or quote.

Outside of these hours, the consultant is not reachable and appointments cannot be scheduled.

The consultant strives to respond to clients promptly but is not contractually bound to any specific response time.

The consultant does not accept urgent assignments, except in exceptional cases, subject to an additional financial compensation agreed upon by both parties.

Furthermore, any service performed outside of regular working hours (i.e., Saturdays, Sundays, and public holidays) or on short notice may be subject to a specific additional fee.

The client is reminded that the consultant retains full independence in managing her schedule and available time slots. Under no circumstances may the client impose constraints or limitations on the consultant’s contractual freedom to set her own availability.

 

Article 6. Respective obligations of the parties

Commitments of the consultant:

  • The consultant commits to deploying all necessary means to meet the needs for which she has been engaged by her clients.

  • She agrees to carry out the service with seriousness, consistency, attentiveness, and kindness.

  • If necessary, she may participate in drafting the specifications in collaboration with the client.

  • She is subject to an obligation of means in the performance of her service, in accordance with common contract law.

  • She complies with her obligation of conformity regarding the services and products delivered. All marketed products are deemed compliant and free from hidden defects. Under Articles L217-4 et seq. of the Consumer Code and Articles 1641 et seq. of the Civil Code, each sold product must conform to its description and be free of any hidden defects.

The consumer or non-professional client has thirty months to assert their rights regarding any conformity issues with the delivered product.

To apply the legal warranty for conformity or hidden defects, it must be proven that:

  • The product cannot be used normally, as would a similar product,

  • The product does not match the description given by the client, even if it functions perfectly,

  • The claimed qualities of the product are non-existent,

  • There is a manufacturing defect, imperfection, or poor assembly,

  • There is a faulty installation rendering the product unusable.


This warranty does not apply in cases where:

  • The sales contract was concluded with a professional client,

  • The claim is made more than thirty months after purchase or order on the website,

  • The defect or issue was already known at the time of purchase,

  • The defect could not have been ignored at the date of purchase,

  • The defect was caused by the user’s misuse.


The consultant will inform the client of any updates, including security updates, specifying their duration clearly and understandably on a durable medium accompanying the sale, free of charge.

The client will also be informed about the impact of updates and software changes on available storage space and RAM during the entire legal conformity warranty period.


The client agrees to:

  • Clearly communicate their expectations to effectively guide the consultant in fulfilling her tasks,

  • Pay the amount due for the reserved service,

  • Not disclose access codes to the consultant’s programs and services, under penalty of suspension and revocation of access rights and damages,

  • Provide all necessary information and documents in due time for proper performance of the services,

  • Actively engage in the support process by using the resources provided and implementing the advice given,

  • Retain final decision-making authority over haircut and hair color performed by the hairdresser partner, whom they are responsible for informing; the consultant’s role is to provide recommendations and accompany the client to the hairdresser,

  • Retain final decision-making authority over cosmetic products recommended by the makeup partner, which are given for guidance only and do not replace a dermatologist’s medical prescription; the client alone is responsible for testing products on their skin to ensure no allergic reaction,

  • Retain final decision-making authority over clothes and accessories they choose to part with during wardrobe sorting; the consultant is not responsible for the donation or sale of the client’s clothes and/or accessories,

  • Retain final decision-making authority over clothes and/or accessories they choose to purchase; the consultant is not responsible for the client’s purchases,

  • Maintain full responsibility for choices related to hairstyle, cosmetic products (not medical substitutes), makeup, as well as clothes and accessories (sorting, donations, sales, purchases).

In general, the client and the consultant agree to actively collaborate to ensure the proper execution of the contract. Each party commits to promptly communicating any difficulties encountered during the project, allowing the other party to take necessary measures.


Both parties agree to a strict confidentiality policy and shall not disclose any information shared during the performance of the services, nor after the contract ends.

 

Article 7. Limitation of liability

The consultant undertakes to implement all necessary means to achieve the client’s style and communication objectives but cannot guarantee any subjective result related to self-acceptance, improvement of self-esteem, or physical appearance.

Under no circumstances shall the consultant’s services replace psychological or therapeutic support by healthcare professionals. These are not medical, psychological, or advisory services intended to substitute those of a regulated or unregulated profession, such as consultations with a psychologist, dietician, naturopath, therapist, or personal development coach, for example.

In the event of force majeure or an unforeseen event, the consultant cannot be held liable. The consultant’s liability will not be engaged in the following cases:

  • Force majeure or unforeseeable events

  • Computer problems or malfunctions

  • Typographical errors or involuntary writing mistakes

  • Subsequent changes in legislation

  • Events beyond the control of the company

Force majeure refers to events or circumstances that are irresistible, external to the parties, unforeseeable, and beyond the control of the parties, despite all reasonably possible efforts to prevent them.

Force majeure also includes transportation or supply blockages, earthquakes, fires, storms, floods, lightning, telecommunications network outages, particularly any networks accessible via the internet, or difficulties related to telecommunications networks outside the parties’ control.

The affected party will notify the other within five business days following the date it became aware of the force majeure event. Both parties will then agree on the conditions under which the contract will continue to be executed.

The consultant’s liability will not be engaged in case of force majeure or gross or intentional fault by the client during the performance of the service.

 

Article 8. Pricing policy

Tailor-made event services
All event image consulting services offered by Phenomen’âme (weddings, religious ceremonies, birthdays, receptions, award ceremonies, appearances & speeches, etc.) are provided exclusively based on a personalized quote, prepared after an initial discovery call or prior discussion with the client.

Each quote takes into account the specific needs expressed, the desired level of preparation, the complexity of the event, the location, as well as the estimated duration of the service.

A quote is valid for 30 days from the date of issuance.No service may commence without the signed quote and payment of the required deposit.

Deposit & payment

The consultant is subject to VAT under the intra-community number FR85929422855.

Any quote is confirmed upon receipt of a non-refundable deposit of 30% including tax, except in duly justified cases of force majeure. The signing of the quote and payment of the deposit guarantee the reservation of the client’s spot in the consultant’s schedule.

In case of late payment, Phenomen’âme reserves the right to suspend or cancel the service without compensation owed to the client.

The balance must be paid no later than 48 hours before the service date, by bank transfer. Cash payments or installment payments are not accepted unless expressly agreed in writing by the consultant. The total amount remains due upon receipt of the invoice, and no payment term exceeding 48 hours is generally granted.

Unpaid amounts will result in immediate suspension of the client’s access to the consultant’s services. Any bank charges or fees related to rejected payments are entirely the client’s responsibility. The client’s account may also be suspended or deleted and will be reactivated only after full settlement of outstanding amounts.

In accordance with Article L 441-6 of the French Commercial Code, late payment penalties equal to three times the current legal interest rate will be applied to the total amount including tax starting the day after the payment due date stated on the invoice, without any reminder being necessary.

If payments are made after the due date, a fixed recovery fee of €40 excluding tax will be charged.

Travel expenses

Services are primarily performed in Paris and the Île-de-France region (zones 1 to 5).

Any travel outside this area, whether in France or internationally, will incur an additional charge covering round-trip transportation costs (tickets, fuel, tolls, etc.), accommodation, and logistics.

Any travel necessary for the proper execution of the contract may also be billed to the client.

Additional fees

Any request for additional services not included in the initial quote and involving extra work for the consultant will be subject to a supplementary detailed quote to be approved and signed by the client.

Urgent services, weekends & public holidays
Subject to the consultant’s agreement, any request made less than one week before the event date will be considered urgent and will incur a surcharge of 50% of the total service price, justified by the exceptional and rapid mobilization of necessary resources.

Similarly, any service requested on a Saturday, Sunday, or public holiday will be subject to a specific increased quote, depending on the consultant’s availability.

Cancellation or modification

All cancellation requests must be submitted in writing (email) at least 48 hours before the scheduled service date.

In case of late cancellation (less than 48 hours before) or client no-show on the day of service, the full amount remains payable, and no refund will be issued.

A rescheduling request made less than 48 hours before the service may be considered exceptionally, depending on availability and provided that the balance has already been paid.

Price revisions and validity of offers

Prices communicated as part of commercial offers, discounts, or promotions are defined or granted by the consultant for a limited period. No discount or deposit will be granted in case of early payment.

Only the signed quote is binding and remains valid under the conditions and deadlines specified therein.

Phenomen’âme reserves the right to revise its prices at any time, without affecting already accepted quotes.

 

Article 9. Booking and ordering process for image consulting services

To confirm their interest in benefiting from the consultant’s services, the client must submit a request via the website www.phenomename.com on the “Contact me” page—either by booking a free discovery call of approximately 20 to 30 minutes, or by sending a message through the contact form. A free discovery call will then be scheduled between the consultant and the client.

This initial exchange is essential for the consultant to understand the client’s needs and to propose a tailored offer aligned with their goals and the nature of the upcoming event.

Following this call, the consultant reserves a period of reflection to carefully review the request. She also reserves the right to decline the collaboration if the issues raised fall outside the scope of her services or for any other legitimate reason, in accordance with Article L121-11 of the French Consumer Code.

If the request is accepted, the prospective client will receive:

  • A detailed and personalized commercial proposal outlining the support provided,

  • A complete quote for the services,

  • These general terms and conditions of sale,

  • An image rights authorization form (if applicable).


To validate the contractual agreement, the client must return the signed and dated quote—either electronically or by hand—with the mention “Approved” (“Bon pour accord”), which confirms that the client has read and accepted these general terms and conditions. This document must be sent to the following email address: contact@phenomename.com or by post to Phenomen’âme, 58 rue de Monceau, 75008 Paris.

In the case of a double engagement with the consultant, the specific terms stated in the quote will take precedence over the general terms outlined in this document.

The client acknowledges that an unsigned quote is valid for one month from the date of issuance. After this period, the quote shall be deemed void.

Signing the quote constitutes full acceptance of the commercial proposal and these general terms and conditions. The payment of the 30% deposit officially marks the start of the consultant’s mission. From this point forward, the consultant will proceed based on the signed quote and will not accept any disputes regarding the elements previously validated.

 

Article 10. Service execution

The services offered are delivered either remotely or in person, based on the information provided by the client and within the timeframe mutually agreed upon. To ensure smooth coordination, communication will primarily take place by email or via the Notion platform for clients whose support includes access between sessions.

In some cases, in-person meetings may be arranged in collaboration with partner companies for services such as makeup, hairstyling, photoshoots, or others, depending on the client’s goals. If both parties agree, these specific arrangements will be defined in writing.

To maintain a fluid support experience, exchanges will mostly be conducted via email or the designated Notion space, depending on the service. The discovery call is held via video conference (Zoom or Google Meet), and a 30-day follow-up is provided via WhatsApp (messages or voice notes) for applicable programs.

For video conferences (Zoom or Google Meet), the consultant will send a link to the client no later than 2 hours before the scheduled session. The client is responsible for checking their email and ensuring a stable internet connection to guarantee a smooth meeting.

Some services include preliminary preparation by the client, who must complete the required exercises on the Notion platform. These exercises are essential to allow the consultant to personalize the service and stay within the agreed timeline.

One day before each session, the client will receive an email reminder with the time, location, and any exercises to complete.

Color Analysis (depending on the program selected by the client)

The consultant determines the client’s color palette using the patented ColorPrecision™ method, developed by the consultant’s training school, IDRI.

This technique relies on analyzing three criteria (temperature, clarity, and saturation), allowing the consultant to provide a personalized color diagnosis and recommend the tones that naturally enhance the client’s complexion, in harmony with their communication goals, personal style, and the tone of the event.

Body shape (depending on the program selected by the client)

The consultant provides a facial and/or body shape analysis, depending on the selected service, to better support the client in achieving their style and event communication goals.

For this, the client is not required to provide their measurements, height, or weight. However, the client is free to share this information if they wish.

Purchase Recommendations for the client (depending on the selected program)
As part of the service, the consultant may suggest clothing, jewelry, accessories, or other types of products for the client. These suggestions are based on research conducted among various companies, and may include priced or non-priced proposals.

It is the client’s responsibility to place orders for the recommended items—or equivalent alternatives—to meet the project brief.

If the client notices a discrepancy in price, quality, or any other element regarding the consultant’s suggestions, they agree not to take any legal action against the consultant, acknowledging the waiver of liability related to the proposed shopping list.

In addition, under no circumstances will the consultant cover any purchase costs. It is solely up to the client to allocate a budget, contact the suggested brands, and assume all financial and logistical responsibilities related to the items. The client accepts any price changes, product defects, or purchase-related issues.

The consultant’s role is strictly to provide style and technical recommendations. The decision to purchase and the purchasing process itself are entirely the client’s responsibility.

 

Inspirations (depending on the service chosen)

The consultant may suggest outfit inspirations, complete looks (including accessories), color combinations, and hairstyle ideas using royalty-free images. These images may not be shared, sold, or redistributed by the client after reception.

Fragrance Recommendations (depending on the service chosen)

The consultant presents the different olfactory families and guides the client toward a perfume selection aligned with their personality and communication goals. No brand will be favored; instead, the consultant will suggest a variety of options from different fragrance houses that meet the client’s needs.

This process aims to help define an olfactory signature that aligns with the overall image built during the coaching journey.


Article 11. End of the service

The service is considered complete once all deliverables have been provided to the client and full payment has been received by the consultant.

At the end of the mission, the client may duplicate their personalized workspace and keep all the content developed during the process. This workspace remains accessible for 90 calendar days. After this period, it may be deleted without prior notice.

A 30-day post-support follow-up is included with any full image consulting service. It allows the client to ask occasional questions or request minor adjustments directly related to the initial support. This follow-up is carried out remotely (via email or message), Monday to Friday, with an estimated response time of 24 to 48 hours.

This follow-up does not constitute a new service or a daily accompaniment. Any request made after this 30-day period will be subject to an additional quote.


Article 12. Personal data processing

The consultant commits to handling the personal data of her clients for professional purposes and for the tasks outlined in the contract.

The data processed for the follow-up of the services are as follows:

  • Last Name

  • First Name

  • Company Name (if professional consulting)

  • Siret Number (for professionals)

  • Postal Address

  • Postal Code

  • Mobile Phone Number

  • Email Address

  • Date of birth (day and month)

  • Profession

  • Clothing preferences (colors, cuts, patterns, style, type of clothing…)

  • Physical characteristics (facial and/or body morphology analysis, hair and eye color diagnosis)

  • Clothing sizes

  • Personal preferences (pets, sports, musical instruments, flowers, living room style, food, vacation spots…)

  • Nature of the event subject to the image consulting service

Certain sensitive data, such as body measurements, may be collected with the client’s consent. This information allows the consultant to recommend a clothing strategy aligned with the client’s style and communication goals for the event.

All sensitive data will be anonymized within 3 months after the completion of the mission to respect the client’s privacy.

The client has the right to access, rectify, port, and erase their data, or to limit its processing, in accordance with the French Data Protection Act of January 6, 1978, as amended, and the European Regulation No. 2016/679/UE of April 27, 2016 (effective May 25, 2018). Any complaint should be preferably addressed directly to the consultant to find an appropriate solution.

In case of a dispute, the client can freely report it to the CNIL (French Data Protection Authority), with the legal information available regarding the consultant; in the Preamble of these general terms and conditions.

The retention and use of personal data cannot exceed 3 years from the date of their first collection.

Article 13. Intellectual property

This clause is drafted in strict compliance with the Intellectual Property Code. The elements provided by the consultant as part of her services remain her intellectual property. All rights of reproduction, modification, and distribution are reserved.

Reproduction, whether partial or total, cannot be carried out without the express consent of the consultant. Each work and communication medium (paper, digital, electronic, oral, etc.) remains the intellectual property and copyright of the consultant.

The client agrees not to use, transmit, or reproduce all or part of these documents for the purpose of organizing or carrying out services related to or similar to the consultant’s activity.

The client is strictly prohibited from donating or reselling the work materials provided by the consultant, under penalty of legal action.

 

Article 14. Confidentiality and professional secrecy

Both parties mutually agree to maintain strict confidentiality and professional discretion throughout the course of the service.
No private, sensitive, or non-public information concerning the other party may be disclosed without their prior written consent.

In the event of a dispute, this obligation remains in effect. Any public statement that could harm the image, reputation, or interests of the other party shall be considered a breach of these general terms and conditions.

 

Article 15. Withdrawal period

Only for consumer or non-professional clients, based on the preliminary article of the Consumer Code.

If eligible, the client has a 14-day withdrawal period to cancel their order free of charge within this period. No payment may be requested during this time, except in the case of an express waiver of this period.

The client’s express waiver of the right of withdrawal allows for the payment of the order to be required before the end of the 14-day legal period, starting from the registration. To withdraw, the client, whether consumer or non-professional, may do so by any means, without the need for justification.

The express waiver of the right of withdrawal applies to the delivery of services before the 14-day period, in accordance with the Consumer Code, which states: ‘The right of withdrawal cannot be exercised for contracts: 1° For the supply of services fully executed before the end of the withdrawal period and whose execution started after the express prior agreement of the consumer and the express waiver of their right of withdrawal.’

The right of withdrawal does not apply to digital products that have been unsealed immediately after delivery, in accordance with the Consumer Code.

 

Article 16. Cancellation

The client may cancel their participation in a service or cancel the validation of their signed quote, provided they notify the consultant in writing at least 15 days before the scheduled date, in order to benefit from a cancellation without fees and a refund of 70% of the amounts paid.

The cancellation must be communicated to the consultant via email at contact@phenomename.com.

 

Article 17. Rescheduling

Any request for a rescheduling initiated by the client must be addressed to the consultant via email at least 2 days before the scheduled date. Beyond this period, no request for rescheduling will be considered. In any case, the service will remain due. However, the consultant reserves the right to refuse the request for the following reasons: current or anticipated workload on the requested rescheduling dates, non-compliance with these terms and conditions, or requested rescheduling not respecting the scheduled rescheduling timelines.

The consultant may also need to postpone the execution dates of the service. In such cases, she commits to informing the client by email as soon as possible. If the client is not available for these new time slots, they will benefit from a free rescheduling of the service to new dates, up to 3 months after the originally scheduled postponement.

 

Article 18. Suspension

The parties may agree to suspend the contract by mutual consent, at least 2 weeks before the desired date. The consultant may also need to suspend the contract for compelling reasons. Reasons for suspension of the contract at the client’s initiative may include illness, a family event, or obstacles in the coaching process. In this case, scheduled payments for the service will be suspended for as long as the service has not resumed.

The resumption of the service takes place once the parties agree to lift the suspension of the contract, by mutual consent. The final decision rests with the consultant.

The parties agree that the suspension period cannot exceed 2 months from the written mutual agreement. After this suspension period, the contract will automatically end, with no penalties or sanctions applicable to the parties.

 

Article 19. Customer satisfaction

To improve the services offered, the consultant reserves the right to request statistical feedback on her services for professional purposes (on her communication materials, to create a commercial analysis report of her practices, etc.).

The consultant may contact the client, after a service, to ask them to complete a customer satisfaction survey, which will be used only for professional purposes and in accordance with the personal data protection policy outlined in this document.

The consultant may share written, audio, or video testimonials, audio or video excerpts of conversations with the client, and photos, in order to promote her business online, without disclosing personal data that could identify the client, unless the client expressly authorizes it.

In accordance with Article 9 of the Civil Code, all clients have the right to protect their image, including their voice, and their private life. The use of photographs, audio, and video involving them must be subject to a written consent for the transfer of image rights. The transfer of image rights granted by the client is valid for 10 years from the date of written authorization.

The transferred image rights apply to all written, audio, and video materials necessary to promote the services provided by the consultant, create advertising or marketing content, and be used on any type of media. The use of these materials is restricted to the European Union.

In other cases, the consultant may anonymously discuss the experiences and transformations of her clients. Acceptance of the general terms and conditions of sale implies acceptance of the sharing, redistribution, and promotion of the client’s experience in anonymous form.

 

Article 20. Litigation

The law applicable to the services provided by the consultant is French law.

The parties acknowledge that the clauses of these general terms and conditions of sale are independent of each other.

For a complaint

In the event of a dispute between the consultant and one of her clients, the client must address a complaint in writing. The consultant has 2 weeks to provide a written response. If the proposed solution does not satisfy either the client or the consultant, both parties will strive to find a favorable resolution amicably, before resorting to any legal proceedings.

For a cancellation

To cancel the contract, the party initiating the request must notify the other party in writing, by email or mail, and respect a one-month notice period from the date the cancellation letter is received.

If this is done within a shorter time frame, an additional penalty of 10% of the total amount stipulated for the service provision will remain payable by the requesting party. If the request comes from the client, this penalty will be added to the amount already received by the consultant for her services.

For a contractual dispute

In the event of a dispute, professional clients must first attempt an amicable resolution before pursuing legal action. Non-professional clients can use the free mediation service provided by CM2C, the competent mediation center for disputes under the consultant’s responsibility, located at 49 rue de Ponthieu, 75008 Paris, https://www.cm2c.net/.

In all these cases, the disputes and conflicts must remain strictly confidential and cannot be the subject of a media crisis caused by either party.

In the event of a dispute and in the absence of an amicable solution, the competent court is the one within the jurisdiction of the consultant’s Court of Appeal, domiciled at 58 rue de Monceaux, 75008 Paris, which is the Paris court, unless otherwise stipulated by law.

 

Article 21. Tools maintenance and availability

The website, workspace (notion.so), WhatsApp messaging, booking tools (Google), video conferencing (Zoom or Google Meet), and Pinterest are available 24/7 without limitation. The consultant does not guarantee uninterrupted operation or error-free content delivery. Due to updates or internal issues, these services may be temporarily unavailable for a given period.

The client agrees to inform the consultant within 24 hours upon discovering any technical malfunction.

In such cases, the consultant agrees to take action to restore proper functionality. However, the consultant is neither the host nor the technical manager of these tools and cannot be held responsible if the links, accesses, or spaces remain inaccessible.

Therefore, no indemnity or financial compensation will be provided by the consultant or their subcontractors.

 

Article 22. Hyperlinks

The hyperlinks on the website may direct to third-party websites, content, or documents. In no event can the hyperlinks (due to their content or creator) hold the consultant responsible.

 

Article 23. Client references

The client authorizes the consultant to communicate their name, logo, or image consulting work in the referral list and portfolio or any other communication aimed at listing the clients and partners of the consultant, including all social media platforms. If the client does not wish to appear in the referral list, they must make an explicit request to the consultant via email or letter.
